Terms of Service
Effective Date: April 8, 2026. Welcome to Echelon OS ("Platform", "we", "our", "us"). Echelon OS is a digital product operated by a privately managed business based in Ahmedabad, Gujarat, India. By accessing or using the Platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform.
1. Definitions
- User / you: Any individual or entity using the Platform
- Account: Registered user account
- Content: Any data, text, prompts, or material
- User Content: Content submitted by you
- AI Output: Content generated by the Platform
- Services: All features provided by Echelon OS
- Subscription: Paid access to premium features
2. Eligibility
You must:
- Be at least 18 years old
- Be capable of entering a legally binding agreement under Indian law
- If using on behalf of an entity, you confirm authority to bind that entity.
3. Nature of Platform (Intermediary Status)
Echelon OS operates as a technology platform and intermediary under applicable Indian laws, including the Information Technology Act, 2000.
You acknowledge that responsibility for use of outputs lies with you.
- We do not initiate, select, or control user-generated content
- We provide automated AI tools based on user inputs
4. Description of Services
Echelon OS provides AI-powered tools including career intelligence and analysis, AI readiness insights, decision-support tools, and content generation and automation.
We may modify, suspend, or discontinue features at any time without prior notice.
5. Account & Security
You must provide accurate information. You are responsible for your account credentials. All activity under your account is your responsibility.
We may suspend or terminate accounts without prior notice for violations, misuse, or security concerns.
6. Acceptable Use Policy
You agree not to:
- Use the Platform for illegal purposes
- Generate harmful, abusive, misleading, or fraudulent content
- Impersonate others
- Reverse engineer or exploit the system
- Bypass security or rate limits
- Use automated scripts to abuse the Platform
- Violation may result in immediate termination.
7. AI Usage & Disclaimer
The Platform uses artificial intelligence. AI Output may be inaccurate, incomplete, or outdated. Outputs are not guaranteed to be correct or reliable.
Outputs do not constitute career advice, financial advice, or legal advice.
Echelon OS does not guarantee outcomes, job results, or market positioning. You are solely responsible for verifying outputs before relying on them.
8. Payments, Billing & Taxes
Pricing is displayed before purchase. Payments are processed via third-party providers such as Razorpay. Subscriptions auto-renew unless cancelled.
All prices are exclusive of applicable taxes, including GST, unless stated otherwise.
9. No Refund Policy
All payments made for subscriptions and Services are final and non-refundable.
By making a purchase, you agree that Services are delivered immediately upon payment and that you have reviewed features and pricing before purchase.
No refunds will be provided for change of mind, lack of usage, dissatisfaction with AI outputs, failure to cancel before renewal, or partial subscription periods.
Refunds may be issued only for duplicate transactions or technical failures attributable to the Platform preventing access. Requests must be made within 7 days.
10. Chargebacks & Payment Disputes
If you initiate a chargeback or dispute via your bank or payment provider, including Razorpay, we reserve the right to suspend or terminate your account, deny future access, and recover outstanding dues.
We may present transaction records, usage logs, and acceptance of Terms to dispute such claims.
11. Subscription Terms
- Subscriptions renew automatically
- Users must cancel before renewal to avoid charges
- Plan changes take effect in the next billing cycle
12. Intellectual Property
The Platform and its technology are owned by Echelon OS. You retain ownership of your inputs.
You may use AI Output for lawful purposes. Outputs may not be unique and may be generated for other users.
13. Data Usage & Consent
By using the Platform, you consent to collection and processing of your data and use of anonymized data to improve services.
Your data is handled as per our Privacy Policy.
14. Third-Party Services
We rely on third-party services for hosting, analytics, AI APIs, payments, and related operations.
We are not responsible for their availability or their data practices.
15. Service Availability
Services are provided on a best-effort basis. We do not guarantee uninterrupted access or error-free performance.
Downtime may occur due to maintenance or external failures.
16. Limitation of Liability
To the maximum extent permitted by law, Echelon OS shall not be liable for indirect or consequential damages, loss of data, profits, or business, AI inaccuracies, or service interruptions.
Total liability shall not exceed the amount paid by you in the preceding 3 months.
17. Indemnity
You agree to indemnify and hold harmless Echelon OS from any claims arising from your use of the Platform, violation of these Terms, or misuse of AI outputs.
18. Termination
We may suspend or terminate access without prior notice for violations, legal requirements, or security risks. Access will cease immediately upon termination.
19. Dispute Resolution
You agree to first contact us for resolution. We will attempt to resolve disputes within 15 days.
20. Governing Law & Jurisdiction
These Terms are governed by the laws of India. All disputes shall be subject to courts in Ahmedabad, Gujarat.
21. Force Majeure
We are not liable for delays or failures due to natural disasters, internet outages, government actions, third-party failures, or similar events outside our reasonable control.
22. Modification of Terms
We may update these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.
